Owners of 13 Pure Nightclub and Bistro are appealing a decision made last week by the Colorado Springs Liquor Licensing Board to suspend the club’s tavern license for 10 days and for it to be held in abeyance for 60 days.
The suspension was handed down in response to 10 separate police vice squad accusations that the club allowed topless female nudity and breast fondling during a Girls Gone Wild promotional event at the club.
The 10-day suspension began Friday night.
“The liquor board said it was indecent and offensive expression,” said attorney Mike Gross. “But it’s our position that it’s protected by the First Amendment, and there are a number of other arguments, including the excessive nature of the punishment.”
The infractions were 13 Pure’s first violation, and liquor licenses are rarely suspended for a first violation.
“It’s beyond unusual. It’s unthinkable,” Gross said.
A temporary restraining order on the liquor board’s decision is scheduled for 9 a.m. Friday, March 27 in Division 1 of the 4th Judicial District.
